Release of liability and waiver of claims

Assumption of risks and indemnity agreement

(Hereinafter, referred to as the “release agreement”)

By checking off in the booking process that you have read and agree to the waiver document and safety video, you will waive or give up certain legal rights, including the right to sue or claim compensation following an accident.

Age restriction: Renter must be 19 years or older with valid identification 

Safety

I acknowledge that I have been advised to wear a helmet and appropriate attire while operating the scooter.

Assumption of risks

I am aware that riding the scooter involves many risks, dangers, and hazards including but not limited to roll-over, fire, collision.

I AM AWARE OF THE RISKS, DANGERS AND HAZARDS ASSOCIATED WITH RIDING A SEYMOUR SCOOTER AND I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE OR LOSS RESULTING THEREFROM.

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT

In consideration of Seymour Scooter Rentals agreeing to permit me to rent a scooter for scooter riding and permitting my use of their services, equipment and other facilities and for other good and valuable consideration, the receipt and sufficiency of which is acknowledged, I hereby agree as follows.

1. To waive any and all claims that I have or may in the future have against Seymour Scooter Rental and its directors, officers, employees, instructors, guides, agents, representatives, independent contractors, subcontractors, suppliers, sponsors, successors and assigns (all of whom are hereinafter referred as “the releasees”) and to release the releasees from any and all liability for any loss, damage, expense of injury, including death, that I may suffer or that my next of kin may suffer as a result of my participation in Scooter riding or use of the equipment due to any cause whatsoever including negligence, breach of contract or breach of any statutory or other duties of care including any duty of care owed under the occupiers liability act, on the part of the releasees and further including the failure on the part of the releasees to safeguard or protect me from the risks, dangers and hazards of participating in the activities  referred to above or due to negligence, breach of contract or breach of warranty on the part of the releasees in respect of the design, manufacture, selection, installation, maintenance, inspection, service or repair of the equipment, or in respect of the provision of or the failure to provident warnings, directions, instructions or guidance as to the use of the equipment.
   
   
2. To hold harmless and indemnify the releasees for any and all liability for any property damage, loss or personal injury to any third party resulting from my participation in Scooter riding or use of the equipment.
   
   
3. This release agreement shall be affective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives in the event of my death or incapacity.
   
   
4. This release agreement and any rights, duties and obligations as between the parties to this release agreement shall be governed by and interpreted solely in accordance with the laws of the province or territory where the Scooter riding takes place and no other jurisdiction.
   
   
5. Any litigation involving the parties to this release agreement shall be brought solely within the province or territory where the Scooter riding takes place and shall be within the executive jurisdiction of the courts of that province or territory.

In entering into this release agreement I am not relying on any oral or written representations or statements made by the releasees with respect to the safety of participating in Scooter riding or use of the equipment other than what is set forth in this release agreement.

I hereby certify the rental equipment as described and agree that I will:

– use the electric rental scooter in a safe manner.

– Use safety equipment

– Return the electric rental scooter in the condition as when I received it

– Pay for any lost, stolen or damaged rental equipment and authorize Seymour Scooter

Rental to directly charge my credit card on file for the amounts to be paid.

Before riding your Seymour Scooter Rental, it is my responsibility and I agree with Seymour Scooter Rental that the rental equipment is in a safe condition to ride. If there are any issues, I agree to call or email and not continue to ride if the rental is felt unsafe to continue to ride.

– Scooter has broken parts

– Flat tires

– Low or dead batteries

The customer hereby agrees to the following: 

1. The customer acknowledges that he or she does not have any physical condition or limitations that would affect the operation of an electric motorized scooter or bicycle.
2. The customer understands that Seymour Scooter Rentals does not carry insurance to cover injuries or damages to property caused by the customer. It is the responsibility of the customer to carry their own insurance coverage for injuries to themselves or others and or damage to the rented equipment or property damages.
3. The customers agrees to assume full responsibility for any and all risks involved in or arising from the customers use of a Seymour Scooter Rental scooter, including but not limited to, the risk of death, personal injury, property damage resulting from undo care and attention from a fall, collision, fire, explosion.
4. The customer agrees to abide by all the terms and conditions.
5. As a precaution, ALL scooters are air tagged for both parties benefit.
6. Helmets are provided, if the rider chooses to not wear the helmet, Seymour scooter is not held by any means for any physical damage to the renter.
7. Seymour Scooter Rental reserves the right to refuse rentals and or cancel reservations

I CONFIRM THAT I HAVE READ AND UNDERSTOOD THIS RELEASE AGREEMENT PRIOR TO SIGNING IT, AND I AM AWARE THAT BY SIGNING THIS RELEASE AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS AND REPRESENTATIVES MAY HAVE AGAINST THE RELEASEES.
